The following claims handling procedures are based on our 1996 Uniform Time Limit Rule and pertain only to the crafts and territories governed by that agreement. Claims for crafts or territories not covered by the 1996 Time Limit Rule should be progressed under the provisions or the agreements applicable to those crafts or territories.
First, we have designed a flow chart outlining the basic steps in the time claim appeal process, including the applicable time limits for each step. The left side of the flow chart pertains to claims initiated by the Local Chairman with a "Letter Claim" while the right side of the flow chart pertains to claims initiated by the Claimant(s). Linked to the flow chart are several sample letters which make up a hypothetical claim file to show how the handling of a claim should progress. The samples, along with a reading of the appropriate agreement rules, should provide a clear picture of the entire process. Notes have been added to provide additional help.
Because the Organization has the burden of proof in progressing a time claim or grievance, it is of the utmost importance to get all of the facts at the very beginning. For this reason we have also included a Statement of Facts Form (in html or Microsoft Word format) which can be distributed to your membership. This form may be useful in securing basic information as well as a detailed description of exactly what took place.
