Award No. 46 of Public Law Board No. 6003 sustained UTU's position that for trains operated exclusively within former BN territories, all locomotives must comply with the standards set forth in the BN Award of Public Law Board No. 419, including a Conductor's desk and light. Since Award No. 46 was rendered, the General Chairman's office has received numerous questions about whether employees have the right to refuse to depart the initial terminal on a locomotive not properly equipped. The BN 419 Award does provide that employees will not be censured or disciplined in any manner for refusing to leave the initial terminal if the locomotive does not have the required equipment. Guidelines have been formulated and sent to all Local Chairmen identifying the required equipment, the circumstances when right of refusal applies and the procedures to follow when exercising that right.
